1. Case name and citation: In re Boston shipyard Corp. , Debtor Appeal of Boston Shipyard Corp. , No. 89-1144 United States court of Appeals, first Circuit. 886 F. 2d 451 Heard June 7, 1989. Decided September 1989 Before CAMPBELL, Chief Judge Reinhardt and Toruella circuit Judges. Its alleged that the ruling in this case was not fair by the fact that the district court that confirmed the bankruptcy of Boston Shipyard Corporation, BSC in favor of the appellee , the US Military Sealift Command, MSC. 2. Key Facts: BSC entered into agreement with MSC to revamp and repair the USNS Mississinewa (a water vessel) at a final pay of $ 4,997,925. Having been not fully aware, it turned out that the contract required much more in expenses than it was originally estimated. On realizing change in the contract specifications; it filed a change authorization order so that the work could be done with the permission of their client MSC. The orders however accumulated at the MSC’s table such that their delayed resolution resulted to a wide financial implication towards BSC. Till August 1985, BSC’s financial condition had worsened a situation that required the contract partner, MSC to make payments. Failure of MSC to pay BSC led to termination of the contract. The pulling out of the contract by BSC Company was based on the fact that the latter company had been declared bankrupt. It’s reported that on October 17th due to failure of MSC to compensate BSC, and was terminated by the government (West’s Federal Reporter, 1990). 3. Legal issues presented before Court: Among the legal issues presented before the court were several factors. That one, BSC as a company pulled out of a contract it had entered into with the US Military Sealift Command, â€Å"MSC†. The second issue was the fact that the latter, (MSC) had declined to make payments to the contractual partner, (Boston Shipyard Corporation, BSC), to cater for the extra expenses that were not budgeted for by the company. The US Military Sealift Command, MSC was â€Å"supposed† to cater for these cost overruns in order for BSC to provide its services. 4. Holding of the court: The US government, on February 25th 1986, through the US Bankruptcy Court, filed a proof of claim of $ 9. 2 million in Reprocurement costs. On the other hand, BSC, objecting to the Proof of Claim, filed a counter Proof of Claim, which was meant to convert the terminated contract into one that could benefit the government. Six months down the line, the bankruptcy court on making first hearing, it passed a judgement that favoured the government on the basis that BSC had without excuse withdrawn from the contract. This was further accepted to at the district court, a decision that BSC appeals to. 5. Reasoning (rationale): That a cardinal change is created or comes to exist in a contract when the contractor finds that he or she is required to execute tasks that are materially different from those that were originally bargained for at the start. Such changes are not subject to rectification, and so the judging on this, the government was in breach (West’s Federal Reporter, 1990). Basing on the fact that this contract was a â€Å"call and inspect† type, which implied that the vessels had to be opened first and scrutinized before establishing the whole cost to be involved in the contract. BSC may not be justified to abandon or pull out of the contract basing on the change orders written to MSC. Delay in the kick off of a contract is expected in any contractual agreement (Magoba Construction Company vs. United States). Talking of the incapability of BSC to deliver its services due to financial incapacity, one may argue that a contractor’s default may be pardoned if the causes seem to be beyond his control (ruling of Southeastern Airways Corporation vs. United States). However, it’s generally understood that as a contractor who makes and accepts bids from the government or any other individual, he should be having enough funds to support the contract. This is subject to change. Justification of the contractors default may be carried out only if the experienced financial problems were caused by factors beyond the company’s control or by the company itself (ruling of the case of National Eastern Corporation vs. United States). BSC also argues that the government’s delay to pay it some amount of money resulted to it being unable to respond to a contract worth $ 6. 5 million. This is not true. Evidence has, right from the beginning that BSC had a thin financial base before the contract was initiated (West’s Federal Reporter, 1990) At the same time, no blame was to be put on MSC for having caused any delay or disruption. Hence, conclusively, BSC’s financial incapacitation deterred the take-off of the contract. A different decision on this would make government contracts quite unworkable, and hence contractors would demand refund, and or financial consideration for any cost overruns. Women’s Rights

Should all women be equal to their status, opportunities and rights? Every woman should have the ability to express their freedoms and rights, deserve equal treatment within their society and region, and every country needs to reinforce the rules for women. There is no dignity and respect for women universally. Gender equality is still out of reach for many women worldwide. Presently, women have gained legal rights throughout the world. The women’s rights movement changed society into what we know today. They have allowed Canadian women to obtain a certain formal equality. They have also allowed women to vote and been given equal pay for equal work, however; women had to fight through difficult times to get through discrimination in the 19th century. In the past, women did not have the rights and freedoms as most men and were treated harshly. In other words, women had almost no rights at all. They were not allowed to vote, they could not hold in public offices, and were not given custody of their children if the couple had a divorce agreement. As a result, they were mainly seen as homemakers. Women were inferior to men in many different ways. Women did not have any property rights and once she was married, she was no longer allowed to own any land or property. A man could sell his house and take all the money for himself, and leave his wife and child behind with nothing. Womenfolk were not considered as people. The women’s rights movement helped them throughout the country by passing laws stating that women could own a part of her husband’s estate. Women were observed as socially and politically inferior and unable to function at the same level as men, however; with the rise of the civil rights movement, this finally made women equal as men. In the 1920’s, the â€Å"Roaring Twenties† spread gender equality dramatically. They began to take on more jobs, and wear more daring clothes. Rebellious and bold women, known as flappers, managed to exemplify women’s role in a social change by expressing equality with men. They proved that they could be more sophisticated than men and can achieve greater success. However, women were still paid less than men because they were cheaper to employ. In 1917, the military voters act gave women, who worked in the military, the right to vote. In 1927, the â€Å"Famous Five†, which included, Emily Murphy, Nellie McClung, Irene Parlby, Louis McKinney and Henrietta Edwards, asked the Supreme Court of Canada one question; â€Å"Are women considered to be people? † The term â€Å"people† did not include women, thus the court announced that women were indeed people too. This legal ruling established that women were to be regarded as equal to men under the law. The â€Å"Famous Five† is the reason why Canada is able to have women vote, thus they are very important for women’s rights. All women have the right for freedom, justice and the pursuit of happiness. They must be considered equal and that they deserve the respect and dignity as all humans get. Women throughout the world are suffering because of the rules that are enforced in a specific area and region. If countries reinforce the rules for women, the world will be a better place for women all around the world. Countries can reinforce the rules by educating women further. Those who are well educated will have fewer children, earn more money, and will get more job opportunities. Their educational achievements can have ripple effects within their family and across the generations. Women with equal access to education, training and means can become a great resort. They can raise the living standards of their families and inject new life into the local economy. Also, investing in women’s education reduces poverty. Countries can also aid and support women by providing them with new job opportunities. Women who stay home become mentally sick and tired. Women who have a job will have new experience and will earn money to survive. It also improves self-value and will improve self-confidence. It will also help the government and the economy to grow exponentially. Also, all women should get equal pay for equal work. In nearly every country, women work for longer hours yet get paid less and are more likely to live in poverty. Economic disparities persist partly because of the unpaid work within families and communities and that becomes their downfall because they face discrimination in the economic sphere. Women in many countries still lack to own property because of gender discrimination. Most countries should reinforce these rules and make women live in a better civilization. Every woman deserves equal treatment within their society. Women in other countries continue to have lower education, fewer rights, and less income. Despite the successes of empowering women, numerous issues still exist in all areas of life, ranging from the cultural, political to the economic. They suffer verbal, emotion, physical and sexual abuse. In Saudi Arabia, women are lacking the rights that they are as human beings because of the Sharia Law. The Sharia Law is a law that neglects the rights and freedoms of every woman in Saudi Arabia. The law makes it hard to live. They are not allowed to drive and cannot dress in public with anything except for a burka. If a woman was caught without a burka, she could obtain a severe punishment with 40 whip lashes. No foreign based law or religious law should be allowed to encroach on women’s rights. India also discriminates against women. In India, lots of women die because of rape. It is an unforgettable moment that everyone would like to avoid at all cost. They will not be able to live a normal life and deal with anxiety for the rest of their life. Women are treated as a sexual object because men do not respect and value women in India. Dowry is another problem in India. This is when the property or money brought by a bride to her husband on their marriage, however; if the bride is unable to pay, she is usually married off and mentally and physically tortured by their husband. Afghanistan is another country that disrespects women’s rights. Under the Taliban rule, women were stripped of all human rights. Women cannot seek for education because the Talibans don’t educate them in any way. They do not want them to be educated and intelligent because it would threaten the male dominance. Women are also not allowed to go to work and are forced to stay home. Afghanistan has the highest rate of violence towards women. The Taliban permits and encourages marriage for young girls under the age of 16. Most women in foreign countries, such as India, Afghanistan and Saudi Arabia, are forced to give up their ambitions, simply because the men feel that it is right to leave it as is. They cannot express themselves freely and are treated unlawfully. Women have endured many hardships and unfathomable oppressions. Despite all the troubles throughout each country and society, women have shown a tremendous resilience and human spirit. In conclusion, each and every woman deserves respect and dignity. Every woman should have the ability to express their freedoms and rights, deserve equal treatment within their society and region, and most country needs to reinforce the rules for women. Women continue to have lower education, fewer rights, and less income within their society. In the 19th century, women were not allowed to hold in a political office and married women had no property of their children and had no role in society. Womenfolk in foreign countries are treated wrongfully and improperly. If countries reinforce the law, they can live a better life so that they can succeed as much as men. All women and men are created equal and that they have equal value and should be accorded to equal treatment eternally.

Lego is one of the most reputed organizations known for having amused and nurtured the building as well as the motor skills of children all over the world. Lego’s reputation lies especially in the fact that it appeals to the children, and parents alike. While the children are attracted by the fact that the toys produced by Lego let them build their own creations, the parents are simply attracted by the educational purpose these toys serve (Moreau & Engeset, 2016) .However, the growth of the organization has never been free from challenges, and in order to sustain itself in future, Lego must be able to evaluate the variety of strategic choices available to the company. Before developing the effective strategies necessary for Lego, a SWOT analysis will help in understanding the situation in a better way: It is not just a toy factory, but it serves to educate the children as well. Its educative value has a great appeal to the consumers. It has earned huge brand recognition across fifty five countries. The market is diversified, as it consists of video games, movies and merchandise. Good advertisement and promotional strategies. Huge competition from rival organizatons. The growing popularity of online games among the children. Further product diversification for different age groups is beneficial. Lego can extend its production to other parts of the world, which are experienced in the manufacture of toys. There is a huge lack of innovation. The organization can face huge competition from other low-cost toy products, as well as the new electronic products (Biancamaria et al., 2014). Although Lego has gained unprecedented popularity among the children, the organization has recently failed to retain its high position in the consumer market, and this would not have happened if the organization could keep on innovating itself with time. Definitely, the Lego brand has been introducing a variety of products, such as video games, jewelry sets as well as amusement parks, however, what went wrong was that it failed to keep its focus on the products, and needless to say it was taking haphazard business decisions.   The discipline in the management system was totally missing. There are organizations such as Mega Blocs, which though are imitating the products of Lego, are offering the products at too cheap a price. Hence, these organizations, which are imitating the products of Lego, are using cheaper materials and yet attracting consumers (Koh et al., 2012). The organization has also been encountering a stiff competition from China, as the nation is much popular for its toy markets, which are also operating globally, and apart from the theme-based toys or traditional toys, educational toys are also popularly found in the market (Hawking, 2013).    Robertson claimed that an organization, before introducing innovation must possess sufficient knowledge about what would be the direction of the innovation. Controlled innovation is highly important for an organization, and here in case of Lego, it can be seen that though it tried to introduce disruptive ideas in business, it failed to overlook the commercial gains for the sake of too much focus on creative ideas (Drucker, 2014).   While the Lego group thought that it was enhancing its revenue through market diversification, the over diversification of the products made their business highly irrelevant and directionless (Power et al., 2016). Certain toy-manufacturing organizations are using the competitive pricing policy for selling their products, and hence the parents irrespective of the brand recognition, are getting attracted to their products, since they are reluctant to invest too much for a toy. The main target customers of Lego has been the children aged between 3 to 12 yea rs, and though the organization has gradually diversified its products for manufacturing toys for toddlers and teens, it did not manufacture anything attractive that could gain the attention of the adults (McGraw et al., 2013). To make the business more sustainable in future, Lego must adopt innovative business ideas that will help in pushing the business forward. The organization must focus on a few products, very much relevant and meaningful in the toy- manufacturing business, instead of the theme parks and the apparels. The organization needs to shut down its theme parks, as it is very much capital intensive, and is hardly offering any lucrative returns to the owners. The organization has been tapping a huge number of franchises; however, before doing the same, the organization must have a strategic and well-integrated approach. Lego is losing market to the virtual games and other rival organizations and hence it is important to stick to the Lego movie concept. Further, the organization must adopt very effective promotional strategies, and the organization must keep on interacting with the consumers via social media platforms. Knowing the target market, broadening the market, and instead of diversifying too much, producing limited products for a wide range of consumers, is always a highly beneficial idea. The organization must come up with compelling online game ideas that can attract the consumers irrespective of age and sex. In addition, it should also introduce a few interesting, participatory games in the â€Å"family fun† category. The organization instead of setting up stores in China, should tie up with a popular Chinese toy-manufacturing organization. In order to bring consumer interest in the toys produced by Lego, it can not only take use of social media marketing strategy, but also can arrange competitions in schools, launching new or re-introducing existent products (Anh, 2014). As and when the organization will stop its aggressive expansion, it will be able to focus much better on limited products, both in terms of production as well as promotion. Universal design of learning has not been addressed in my country, Saudi Arabia. It is an emerging topic that being discussed, but, there is no research conducted in this topic yet. The lives of these two men are strikingly different, and perhaps this is reflected in the different ways in which they are considered and worshipped. Jesus promoted peace and goodwill to all men, was destined for his role as a spiritual leader at the moment of conception, and is worshipped as a divine entity. In contrast, Muhammad was a powerful political and military leader as well as a religious one, and is not worshipped as a divine entity, but simply as a prophet, or messenger of God. The Life and Death of Jesus Christ Jesus is thought to have been born in Bethlehem, in or close to 4 BC (Bockmuehl, 13), and to have been raised in Nazareth by parents Mary and Joseph. Joseph was a carpenter by trade, as was Jesus himself. Jesus was a devout Jew (Bockmuehl, 15), but it is thought that his interpretation of the Torah was significantly different from what was generally accepted. The Gospels frequently describe incidents in which Jesus debated scripture and was critical of certain Jewish sects, most notably the Pharisees. In the absence of other historical sources, the Gospels are the main source of information about the life of Jesus. Little is known about the events that occurred between Jesus’ birth and his emergence as the leader of a religious movement. At an unknown point in his life, Jesus became a follower and friend of a prophet named John the Baptist (Bockmuehl, 22). After the arrest of John the Baptist, Jesus began preaching. He taught that the kingdom of God was imminent and that repentance of sins and acceptance of the Gospel was necessary to â€Å"acquire treasure in heaven† (Mark 10:21). It is thought that Jesus’ ministry lasted approximately three years. According to the Gospel of Matthew, Jesus traveled throughout Galileee, teaching in synagogues and open fields alike, healing the sick, and â€Å"proclaiming the gospel of the kingdom† (Matthew 4:23). Jesus used parables extensively, presumably because they made his messages of faith and forgiveness easier to understand. The events culminating in Jesus’ crucifixion occurred in Jerusalem (Bockmuehl, 36). According to the Gospels, he caused a disturbance in a temple by overturning tables belonging to moneychangers and preventing the passage of people who used the temple as a sort of shortcut through the city. Ultimately, he was executed because his teachings and actions made him a threat to the stability of established religion and power structures (Bockmuehl, 96). Jesus’ death is perhaps more important than his life, in terms of the impact it has had on the popularity and acceptance of his religious teachings. If Jesus had not died a martyr, Christianity would not exist as we know it today. Even more important than his manner of death, however, are the Gospel reports which state that three days after his death, his tomb was empty, and that he was subsequently seen alive by the disciples (Bockmuehl, 102). Regardless of whether or not Jesus was actually resurrected, belief in the resurrection is the defining principle of the Christian faith, and is the basis for the enormous impact of Christianity on the Western world. Jesus’ resurrection increases the significance of his death and validates the messages of his ministry (Bockmuehl, 101). The Life and Death of Muhammad Unlike Jesus, who, having been conceived immaculately was destined for greatness, Muhammad was a middle aged man before he received his calling (Cook, 14). Muhammad was born in or around 570 AD, and did not â€Å"receive his mission† (Cook, 14) for over forty years. This occurred on Mount Hira, near Mecca. It is said that as Muhammad lay asleep, the angel Gabriel came to him in a dream and revealed to him the first of a series of scriptures which eventually became the Koran. Muhammad subsequently spend ten to fifteen years in Mecca (Cook, 16), where he not only made many converts, but was also visited repeatedly by Gabriel, who introduced him to Abraham, Moses, and Jesus and allowed him to visit heaven. At this time, Paganism was the predominant religion in Mecca, and while Muhammad was mocked by some, he and his new religion were mostly tolerated. However, Muhammad began to criticize Pagan gods, and hostility was the eventual result, as city rules feared that the turbulence caused by religious division might limit trade between Mecca and other cities. A number of Muhammad’s followers fled to Ethiopia to escape persecution (Cook, 18). Muhammad himself eventually found protection in the form of tribesmen located in the northern city of Medina, who apparently saw Muhammad’s religion as a means of uniting their city, which was then fraught with internal political division (Cook, 19). Muhammad’s move to Medina took place in 622 AD, and is called the hijra. The year in which this occurred became known as the first year of the Muslim era. Once settled in Medina, Muhammad succeeding in uniting the warring Arab factions by enveloping both under the Muslim umbrella (Cook 21). With bloodshed between Muslims forbidden, the feud was effectively halted. With internal peace assured, Muhammad turned his attentions to external enemies, the chief of these being his home town, Mecca. He achieved a number of military successes, including the invasion and capture of Mecca (Cook, 22). His religious message spread as his conquests continued, and many Arab tribes submitted to his political and religious authority. Muhammad continued to receive visits from Gabriel, and many of the rituals which define Islam originated in this way (Cook, 23). Unlike Jesus, Muhammad died peacefully, of an unknown illness (Cook, 24), and was survived by nine wives as well as four daughters. Military operations continued in the name of Islam after his death. Muhammad had apparently planned to send an exploratory expedition to Palestine (Cook, 22), but died before this could be carried out. However, within a generation after his death, the Middle East had been conquered by the Muslims. Historical Worship of Jesus and Muhammad Jesus was an object of worship within a generation after his death (Bockmuehl, 220). Christ was invoked in prayer and hymn as early as the first century AD. However, it was not until the fourth century that Christianity was widely accepted (Bockmuehl, 223). At this point religious iconography began to appear in public displays, and purpose-built Christian churches were erected as the Christian faith became more organized and hierarchical. The importance of Christianity steadily increased until the end of the Middle Ages, at which point Christianity was the center of all aspects of life. Art, literature, music, and architecture were created to glorify Christ and depict Biblical events. Also at this time, religious art began to explore the human side of Jesus (Bockmuehl, 225), portraying his mental and physical anguish in realistic crucifixion scenes. It was not until the Italian Renaissance and Humanistic philosophy of the fifteenth century that secular art and literature began to appear. The self-exploration prompted by the Renaissance eventually gave rise to schisms within the previously unified Christian church. In the modern world, Jesus is increasingly viewed as just one of many prophets, including Moses, Muhammad, and Buddha (Bockmuehl, 237). Worship of Jesus in the twenty-first century is perhaps more personal than it once was, with less emphasis on organized religion and more emphasis on a personal relationship with Christ. This is perhaps necessary in a world which is increasingly secular, where there are many different religious denominations which identify as Christian, and where Christianity is no longer an entity which dominates every aspect of both public and private life. Unlike Jesus, who is worshipped as a divine entity, Muhammad is worshipped as a prophet or messenger of God, rather than a divine being (Cook, 83). Muhammad was not only a religious leader, but a political and military leader as well. The monotheistic faith that Muhammad created gave Islamic Arab nations the political stability that enabled them to become one of the world’s major civilizations (Cook, 86). Within two hundred years of Muhammad’s death, the Islamic religions had spread far beyond the borders of Arabian countries (Cook, 87). In the modern world, the faith is no longer spread via conquest of other countries, despite the efforts of extremist sects such as Al-Qaeda. As with Christianity, the basic tenets of Muslim faith remain unchanged, however the modern world has indeed influenced Muslim practices (Rippin, 127). Similar to the way in which the increasing separation of religion and state influenced Christianity, this division, together with the existence of the Muslim faith in countries which are not predominantly Muslim, has made the religion more of a personal choice and less of a political or national way of life. Just as with Christianity, numerous Muslim sects exist in the world. However, for devout Muslims, the rituals and practices of the faith remain virtually unchanged in comparison to what they were during ancient times. Conclusion The lives and deaths of Jesus and Mohammad have been just as influential in their respective religions as their teachings, if not more so. Both managed to unite innumerable people under one religion in different ways, which are reflected in their teachings and the events of their lives. Both were the figureheads of monotheistic religions, but had very different teachings. Jesus’ main message was the importance of love of both God and of fellow man, while Muhammad promoted unity within the Muslim community but used war as a means of spreading the Islamic faith to new lands. Harassment Essay Harassment at the workplace is one of the major issues that the hospitality industry faces. According to Yeung (2004), the hospitality industry has such peculiar characteristics that make ethical issues particularly important. Drawing on various studies conducted by among others Vallen and Casado, Weaver et al, Enghagen and Hott, and on the basis of his own studies, Yeung (2004) particularly identifies issues such as sexual harassment, and harassment on the basis of race and ethnic affiliation as one of the most outstanding issues in the hospitality industry. According to Perry (2008), employee harassment within the hospitality industry is rampant, and takes the form of gender, racial, or ethnic discrimination. While cases of harassment in other industries are declining, in the hospitality industry employee harassment cases are on the rise (Perry, 2008). This can be attributed to various reasons, chief of which is the fact that the hospitality industry is characterised by a rich ethnic diversity. With many ethnic groups working together within the restaurant setting, for example, Perry (2008, p. 2) writes that â€Å"the friction that commonly occurs between the kitchen and waitstaff often manifests itself in insults and epithets which target race, ethnicity and gender. † Additionally, managers in the hospitality industry have taken to socializing with or dating non-management employees, many of whom are in their teens or pre-teen years, which has the potential of triggering off a sexual harassment lawsuit (Perry, 2008). Another equally important contributory factor to the high levels of employee harassment within the hospitality industry has to do with the dysfunctional rates of employee turnover within the hospitality industry. In the UK for example, Anonymous (2006) estimates that employee turnover is so high that by 2014 an extra 850,000 employees would be needed by the UK hospitality industry. According to Perry (2008), the fact that many employees are leaving the industry, and many others joining the industry, makes it extremely difficult to tailor training programs such as gender awareness training, which has in turn led to the runaway rates of harassment cases. Yet another feature of the hospitality industry is that it is frequented by a lot of young employees, most of whom are in their teens, and for whom subjects as who is sleeping with who are popular topics with them, a factor that has in many ways helped spark off lawsuits even in cases where such claims have merely been rumors (Perry, 2008). According to Rocsigno, Lopez and Hodson (2009), harassment at the workplace is triggered off by events that are both external and internal to organizations. Harassment can occur in three ways. It can be a top down process (where subordinate employees are harassed by their managers or supervisors), lateral (where subordinate employees are harassed by their own peers), or a bottoms up process. According to Eaton (2004), within the hospitality industry, non-employees (guests) may also direct harassment at employees. Eaton (2004) states that while the law is very unequivocal when it comes to the need for establishments within the hospitality industry to both prevent and remedy sexual harassment in the workplace when carried out against employees by other employees or supervisors, when it comes to harassment against the employees by guests, it is more interested in what the hospitality operator did to remedy the complaint rather than what he did to prevent it. The law requires that the operators take â€Å"reasonable cause† to remedy such situations, but what is reasonable is left to the discretion of the judge or jury. Ajagunna (2006, p. 259) also states that guests may be harassed and draws on a study he conducted on the impact of harassment of tourists in Jamaica by â€Å"beach boys, street vendors, art and craft vendors, taxi operators and beggars† Roscigno, Lopez and Hodson (2009) identify various manifestations of harassment at the workplace ranging from physical assault to the understated extreme of psychological attacks. In between, we have forms such as constant criticism of the employees or unwarranted disparagement of their opinions. Verbal attacks, the use of demeaning language against an employee, disgraceful comments about the person, or isolation of the employee are other manifestations of harassment. Additionally, employees may be harassed by being made the subject of practical jokes, by being overworked, or being subjected to unreasonable pressure or being given unreasonable deadlines. Other common ways through which employees are harassed include sabotaging their work, imposing responsibilities that are way beyond their ability to perform, or being excessively monitored by their managers or supervisors. Causes of harassment In their evaluation of harassment at the workplace, Roscigno, Lopez and Hodson (2009) explain that harassment occurs when offenders get the chance to hit out at their victims because capable guardians are not present. In such an instance, junior employees are powerless against their supervisors or managers, who can then harass them at will. Towards this end, the writers identify various causes of harassment, the first one of which is race and ethnicity. While an employee’s race and ethnicity accentuates the disparities between him and his fellow employees in as far as status and power are concerned, it makes the employee an easy and soft target for harassment, especially in the event that the employee is a member of a minority group. These employees tend to be more isolated from the dominant groups leading to a high degree of harassment against them (Roscigno, Lopez and Hodson, 2009). One’s gender also plays a big part in influencing harassment at the workplace, with female employees often bearing the brunt of unwelcome sexual advances which may be displayed through touching, the use of off-color jokes, the display of material with explicit sexual content, and so on (Roscigno, Lopez and Hodson, 2009). In particular, Eaton identifies two kinds of sexual harassment recognized by law: the â€Å"quid pro quo† type where sexual favors are either explicitly or implicitly solicited in return for a job or a job benefit, and the use of unwelcome physical or verbal behavior against an employee by virtue of his or her gender, and which is detrimental to him or her. Harassment also results from occupational and status disparities. Rocsigno, Lopez and Hodson (2009) report that lower cadres of employees are often measly wages and allowances, and given that they report to supervisors who wield a lot of influence and authority, they are easy targets of harassment. Conversely, the authors write that employees who possess high levels of education are not easily amenable to harassment for the reason that they tend to be more conversant with employee protection rights as well as with grievance procedures (Rosigno, Lopez and Hodson, 2009). Rocsigno, Lopez and Hodson (2009) also identify high levels of job insecurity as a contributor to harassment at the workplace. They adduce documentary evidence to show that increasing job insecurity at the workplace has sparked off increases in workplace harassment. For example, an increasingly competitive environment has led to many organizations outsourcing some of their non-core functions, in the process laying off some of their workers and increasingly making use of contingent employees. According to Rocsigno, Lopez and Hodson (2009), many employers are exploiting the fear employees have of losing their jobs to make them agree to things they would ordinarily not assent to. The writers indicate that the use of explicit or implicit sack threats to get workers doing what their employers or supervisors want is rife. Contingent workers also perform work that is of low value, and are more amenable to intimidation by their employers (Rosigno, Lopez and Hodson, 2009). Yet another cause of workplace harassment identified is that where employees harass their fellow employees because they are in competition and feel threatened that their fellow employees are better than them and are thus likely to make them look bad (Rosigno, Lopez and Hodson, 2009). In addition, the organization culture espoused or enacted by the hospitality establishment also plays a big rile in either contributing to or lessening harassment at the workplace. For example, an organizational culture that seeks to exercise high control of employees (through the use of techniques such as standard operating procedures and excessive supervision) is likely to result in higher incidences of harassment at the workplace as opposed to those which seek to empower rather than control. Another aspect of the organization that has been found to be critical in either ameliorating or worsening harassment is how well organized and articulate the procedures in the organization are, with chaotic procedures often contributing to higher levels of harassment (Rosigno, Lopez and Hodson, 2009). As mentioned earlier, Rocsigno, Lopez and Hodgson (2009) have attributed workplace harassment to powerlessness, where sufficiently motivated harassers take advantage of the absence of a capable guardian to harass their victims. An example of a capable guardian is the trade or labor union, which has helped reduce workplace harassment through their grievance procedures and their capacity to offer arbitration in dismissal cases. Rocsigno, Lopez and Hodson (2009) however report that in recent times the influence and sway of the trade union movement has considerably weakened a factor that has also had some effect in increasing harassment cases. Other capable guardians identified include the extent of accountability which employers or supervisors have towards their employees, and the strictures put in place by the organization to guarantee the rule of law within the organization (Rosigno, Lopez and Hodson, 2009). Impact of harassment Harassment at the workplace has very costly ramifications for establishments within the hospitality industry. According to Perry (2008), workplace harassment has been known to exact a huge financial toll on organizations. Moreover, harassment cases generate a lot of adverse publicity for the establishments, which has the capacity to bring them down, given the fact that hospitality establishments such as restaurants depend very much on having a good reputation (Perry, 2008). According to Vaez, Ekberg, and LaFlamme (2004), employees who fall victim to harassment normally predisposed to a higher risk of suffering from stress and psychological unease. They exhibit higher rates of absenteeism and typically have higher employee turnover rates than those employees who are not subjected to intimidation. Measures to reduce harassment There are several measures which establishments within the hospitality industry can take in order to minimize the effects of workplace harassment. According to Perry (2008), hospitality establishments need to formulate written policies which clearly articulate that recruitment, hiring, firing and other HR practices will not be influenced by gender, age, religious, or racial considerations but will be purely based on merit. Having formulated such policies, the establishments need to ensure that the policy is enforced and to undertake regular audits to determine whether the policy is being followed or not. All employees should be made aware of the policy and must sign against it (Perry, 2008). As a way of minimizing workplace harassment to the bare minimum, hospitality organizations will also need to set up third party channels such as employee hotlines, where cases of harassment can be reported. Additionally, the organizations must also ensure that formal complaint procedures are in place and that they are known by all employees (Perry, 2008). According to Perry (2008), hospitality organizations need to offer training to their employees to educate them of the need to refrain from practices that can constitute harassment. Training the employees will not only help provide a valid defense but will also be useful in helping employees â€Å"to recognize their own unconscious motivations and how to avoid interacting in ways that can be offensive to other people† (Terry, 2008, p. 45). The training should cover all the harassment laws, and should be offered both to employees in management positions and subordinates. In the event that cases of harassment are reported, the organization’s response will also count for a lot. In such instances, the organizations must move with speed and investigate such complaints objectively and fairly, preferably by a person who is not a member of the management team such as an external consultant or the human resource head. As Perry (2008, p. 45) writes, Employers who have happy employees who respect each other and interact well are likely to retain them longer. Fair treatment goes a long way toward being the employer of choice.

SOPs are an effective tool to keep every action on line with the planning. All above are absolutely necessary for successful running of a business and more particularly for a business of the magnitude of The Greenland Rail Company spread countrywide by its services and utility to the nation. SWOT Analysis SWOT is abbreviation of four words which in fact gives four dimensional view of any issue or idea. There is nothing new in this. Everybody thinks on the pros and cons of an idea before putting it into practical shape or taking practical step. This provides the base for generating the operational plans for any new ventures within the existing business. The need for documenting the strategic planning cannot be over emphasized. Internal Audit Or The Check List To Cross Check The Actions With The Planning Internal audit and the checklist are two different things but serve the same purpose. The internal audit is carried out by another official of the organization whether the operators are performing correct actions. The checklist provides correct sequence of actions to be done by the operator. The checklist is guiding method whereas internal audit is pointing out the mistakes. However, both have their utility and should always exist. Standard Operating Procedures (SOPs) SOPs are an effective tool to keep every action on line with the planning and in fact operational plan translated in simpler form so that everybody at every level can understand the right way of doing an action. SOPs tell the only way an action has to be done and thatg is the desired action according to the operational plan. Method Of Remedial Measures We can say the last in the series is description of remedial measures. If the SOPs are being followed, no remedial measures are required. They are only for emergencies and accidents. However accidents and emergencies do not occur frequently but remedies should be well thought and well planned. They should be a part of SOPs and be documented properly. In this section we shall see the competitive strengths and weaknesses of the current business strategies. Effective marketing and good customer care service All above have all the strengths and bright chances of success. Despite these strengths it has weaknesses that it lacks locomotive production facilities and expertise, both. This is one weakness that can put the entire plan at stake of failure. However this weakness can be overcome by importing the locomotives in time and by having a good repair and maintenance workshop of its own. Its strengths can be enlisted as under: It can schedule the trains on the needs of the customers It can provide sufficient number of trains It can employ sufficient staff and can train them at its own training facilities It can allocate sufficient resources It can maintain good service standard It can have effective marketing and customers care Its weaknesses can be visualized and enlisted as under: Any breakdown of locomotives can adversely affect the schedule Motivation of the staff can be doubtful and may not prove to be as efficient as ideally required. The competitors, the road transporters can also provide the same facilities with good standard and efficiency. Track needs to be maintained continuously and may not be possible to do it. It is susceptible to miscreant actions and any defect in the track can stop the movement of trains and affect the schedule very badly. The company has single track and lacks the double track facility causing unnecessary delay in allowing the crossing of other train. There can be human error that can cause severe hindrances and even accidents. Despite these weaknesses the company has been running the trains by making an intelligent time table. However the efficiency of double track cannot be achieved by single track. The major problem faced by the company has been shortage of locomotives and making no provision for timely actions. Frustration in employees has been another factor. Core Business Values And Current Objectives Core business values are efficient service for passengers and goods transportation. Safety of passengers, comfortable travel and adhering to strict time schedule are the core values in case of passenger travel service. On the other side, transportation of goods in safe and timely manner are the core values for the cargo service. Its current business objectives are still the same, I e: To operate the trains and make the company a profitable organisation. The costs have to be met under all circumstances otherwise it would not be possible to run the trains under the conditions of continuous loss. The business objectives can only be achieved if there is efficiency in service. It is a circle; efficiency will capture the market and increase the customers and volume of goods to be transported. Low efficiency will cause losses on every side. The market will slip over in the hands of competitors and there will be sharp decline in the health of the company The comparison between the values and the objectives in now lopsided and in unfavorable balance. Values alone can do nothing if not supported by the efficient service. Loss of efficiency will result in loss of customers and cargo and that will push the company towards a sad catastrophe. Presently it is not meeting its objectives and core values are left unsatisfied. In addition, GM crops could be very beneficial and make a great future for all people.But without careful and frequent study and research, proper decisions about the cultivation and use of GM crops can never be made. Research on GM crops by public institutions is absolutely indispensable in order to find more information about the issue. Without this research, a ban on GM crops is definitely not the best idea. Since genetically modified foods have been on market shelves for over twenty years and there has been no proof that they hurt anyone, it is safe to assume that no one will have a late health egress from digesting a GM food they had over a decade ago.Instead of banning the research and cultivation of the GM foods, research should be accepted to be searched about the topic because eventually the GM food industry could do wonders.
